English law generally allows individuals complete freedom to dispose of their estate by will, unlike many jurisdictions that require nationals (and sometimes residents) to leave a portion of their estate to family members. However, English law does provide rules for the distribution of an estate where there is no valid will in place.<\/p>\n\n\n\n

English law allows certain individuals to bring claims for reasonable financial provision from the estate of a person who has died domiciled in England and Wales. This is particularly important where a person dies without a valid will and the intestacy rules do not make adequate provision (or any provision) for them.<\/p>\n\n\n\n

Under the Inheritance (Provision for Family and Dependants) Acts 1975, claims may be brought by:<\/p>\n\n\n\n

    \n
  1. a spouse or civil partner of the deceased;<\/li>\n\n\n\n
  2. a former spouse or civil partner of the deceased (but not one who has formed a subsequent marriage or civil partnership);<\/li>\n\n\n\n
  3. a child or children of the deceased;<\/li>\n\n\n\n
  4. any person who was treated by the deceased as a child of the family;<\/li>\n\n\n\n
  5. any person who immediately before the death of the deceased was being maintained, either wholly or partly by the deceased (which can include a cohabitee). \u00a0\u00a0<\/li>\n<\/ol>\n\n\n\n

    The court has the power to order such financial provision as it considers reasonable in all the circumstances, which may include the transfer of cash or property from the estate to the claimant. In some cases, these orders can extend to assets held in certain trusts or lifetime gifts made by the deceased. <\/p>\n\n\n\n

    Claims must generally be issued within six months from the date on which a grant of representation is obtained.<\/p>\n\n\n\n

    It is important to obtain specialist advice at an early stage in relation to any potential inheritance claims for financial provision. <\/p>\n\n\n\n
